Legal Notices and General Terms and Conditions of Use for the Website

Preamble

By continuing to browse the www.bonanza.co website (hereinafter“the Site”), visitors to the Site (hereinafter“Users”) unconditionally accept the following terms and conditions of use (hereinafter“Terms of Use”). Before using any features of our Site, the User acknowledges having read and accepted these Terms of Use.

The version of our Terms of Use currently online is the only one that is legally binding for the entire duration of use of the Site and until we replace it with a new version.  The Site is managed by BONANZA ( hereinafterthe “Publisher”), which reserves the right to modify these terms at any time.

Any use of the Site following a modification to the Terms of Use constitutes the User’s irrevocable acceptance of the new version. If the User does not agree with our Terms of Use, the User is asked to stop using the Site.

Article 1 – DEFINITIONS

On the Site, the terms below have the following meanings:

‍“Content”:refers to all elements comprising the information on our Site (text, images, videos, algorithms, software, widgets, etc.) and enabling its operation, the provision of information to the User, and the presentation of our services;

‍“Intellectual Property Rights”: refers to all intellectual property rights and related rights (copyrights, trademark rights, patent rights, trade names, databases, etc.) as protected by the Intellectual Property Code established by Law No. 92-587 ofJuly 1 , 1992, the current version of which is the one applicable at the time the User accesses the Site;

“Publisher”: refers to SAS Bonanza, with a capital of €11,028.99, registered with the Nanterre Trade and Companies Register under number 820 134 245, and whose registered office is located at 37 rue Gabriel Péri, 92300 Levallois-Perret, which may be contacted by email at contact@bonanza.co;

‍“Features”:refers to all features made available to Users via the Site;

‍“Site”:refers to the website www.bonanza.co operated by the Publisher and made available to the User;

“User”:
refers to any individual using our Site and having access to its content.

Article 2 – LEGAL NOTICE

Pursuant to Law No. 2004-575 of June 21, 2004, on confidence in the digital economy, users of the Site are hereby informed of the identities of the parties involved in its creation and maintenance:

Article 3 – PROTECTION OF NON-PERSONAL DATA

In connection with the use of the Site, the Publisher processes certain personal data concerning Users. This processing is carried out in accordance with Law No. 78-17 of January 6, 1978, as amended, relating to information technology, files, and civil liberties (known as the “Data Protection Act”) and the Data Protection Policy available in the corresponding tab on the Site (the “GDPR” tab).

Article 4 – Collection of Personal Data

The Publisher strives to provide information that is as accurate as possible, but is not responsible for any omissions, inaccuracies, or failures to update the information. All information provided on the Site is for informational purposes only and is not exhaustive; it is subject to changes that may have been made since it was posted online.

Article 5 – ACCESS TO THE SITE
5.1 General Provisions

Access to and use of the Site are strictly limited to personal use. The User agrees not to use the Site or the information or data contained therein for commercial, political, or advertising purposes, or for any form of commercial solicitation, including the sending of unsolicited emails.  

Users are solely responsible for setting up the computer and telecommunications equipment necessary to access the Site. They are responsible for any telecommunications charges incurred while accessing the Internet and using the Site.

5.2 Use of the Site's Services

The Publisher shall not be held liable if a User has provided false personal information when subscribing to the Services.

The User is solely responsible for the accuracy of the information provided when subscribing to the Services. As such, the User agrees to update the information as necessary. The Publisher shall not be held liable in the event of incomplete, inaccurate, or missing data that has had a direct or indirect impact on the use of the Site.

Article 6 – INTELLECTUAL PROPERTY
6.1 The Website

All trademarks, photographs, text, comments, illustrations, images (whether animated or not), video clips, sounds, as well as any computer applications that may be used to operate the Site, and more generally all elements reproduced or used on the Site, are protected by applicable intellectual property laws.

They are the full and exclusive property of the Publisher or its business partners. Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the Publisher’s prior written consent, is strictly prohibited. The fact that the Publisher does not initiate legal proceedings immediately upon becoming aware of such unauthorized uses does not constitute acceptance of said uses or a waiver of the right to pursue legal action.

Users are strictly prohibited from:
- Copying, reproducing, displaying, broadcasting, distributing, or publishing, whether permanently or temporarily, all or part of the content and/or the Site by any means and on any medium, whether known or unknown at this time;

Creating derivative works based on the content and/or the Site;

Modify, translate, adapt, or arrange all or part of the Content and/or the Site;

Disassemble, decompile, or reverse engineer the Site.  

In any event, the User is solely responsible for their use of the Site. Any unauthorized use of the Site or any of the elements it contains shall be considered an infringement and shall be prosecuted in accordance with the provisions of Articles L. 335-2 et seq. of the Intellectual Property Code.

6.2 Our Brand

The Publisher’s and BONANZA’s word marks and visual marks (logos) are protected. Their use without written authorization from the Publisher or its partners on any medium, for the purpose of promoting products or services, or for commercial purposes, is prohibited and may result in criminal and civil legal action by the Publisher against the user and/or any liable third party.

6.3 Content

Some content is available for free access on the Site. The publication of this content online does not imply a transfer of copyright or ownership rights to the content, which remains the full and exclusive intellectual property of the Publisher and the contributors. 

No User may or shall take any action that is incompatible with respect for copyright and intellectual property rights or that violates any other French or international law relating to intellectual property rights. The Publisher and its contributors reserve the right to take legal action against any User for any violation of these provisions.

Article 7 – SITE MANAGEMENT

The Site is normally accessible to users at all times. To ensure the proper management of the Site, the publisher reserves the right at any time to:  
- Suspend, interrupt, or restrict access to all or part of the Site, for any reason whatsoever, with or without notice, and at its sole discretion;

Remove any information that may disrupt the Site’s operation, for any reason whatsoever, with or without notice, and at its sole discretion;

Suspend the Site in order to perform updates.  

The Publisher will make every effort to notify users in advance of the dates and times of such maintenance, but cannot be held liable in the event that prior notice is not provided.

Article 8 – LIABILITIES
8.1 Access to the Site

The Publisher undertakes to do everything in its power to ensure that the Site is accessible 24 hours a day, 7 days a week. However, the Publisher makes no commitment regarding the Site’s availability or continuous accessibility and does not guarantee that the Site will be error-free. The Publisher shall not be held liable in the event of a failure, breakdown, difficulty, or interruption in operation that prevents access to the Site or any of its features.  

The Publisher and the hosting provider shall not be held liable in the event of a malfunction of the internet network, telephone lines, or computer and telephone equipment, particularly due to network congestion preventing access to the server. 

The publisher shall not be held liable in the event of legal proceedings brought against users:

As a result of the use of the Site or any other service accessible via the internet;

As a result of the user’s failure to comply with these Terms of Use.

8.2 Equipment Used

The User is solely responsible for the equipment used to access the Site. The User must take all appropriate measures to protect their equipment and their own data. The User agrees to access the Site using up-to-date equipment that is free of viruses and a recently updated browser.

The Publisher is not liable for any damage caused to Users, third parties, and/or their equipment as a result of their connection to or use of the Site, and Users waive any claim against the Publisher arising therefrom.

The Publisher shall also not be held liable for any indirect damages (such as, loss of business or loss of opportunity) resulting from the use of the Site.

Article 9 – PHOTOGRAPHS

The photographs on the Site, along with their descriptions, are not binding and do not constitute a commitment on the part of the Publisher.

Article 10 – HYPERLINKS

Users are authorized to create hyperlinks to all or part of the website, subject to prior written authorization from the Publisher, which must be requested by email at the following address: contact@bonanza.co.

The Publisher is free to deny such authorization without having to justify its decision in any way. Should the Publisher grant its authorization, such authorization is in any case only temporary and may be revoked at any time without the need to provide justification. In any event, any link must be removed upon simple request by the brand.  

The site contains a number of hyperlinks to other sites, established with the Publisher’s permission. However, our company is unable to verify the content of the sites visited in this manner and therefore assumes no liability in this regard.

Article 11 – PARTIAL INVALIDITY

The temporary non-enforcement of one or more provisions of these Terms and Conditions shall in no event be construed as a waiver by the Publisher of its right to enforce any of said provisions.  

If one or more of the provisions herein were declared null and void or unenforceable by law, regulation, or as a result of a final court decision, the remaining provisions would retain their full force and effect and would continue to apply in full.

Article 12 – LANGUAGE

In the event that these general terms and conditions are translated into one or more languages, the French language shall prevail in the event of any contradiction or dispute regarding the meaning of a term or provision.

Article 13 – GOVERNING LAW

These Terms of Use for the Site are governed by French law and—in the event of a dispute—are subject to the exclusive jurisdiction of the competent courts of general jurisdiction, subject to any specific allocation of jurisdiction arising from a particular law or regulation.

Article 14 – ASSISTANCE

The Publisher’s technical team provides support Monday through Friday from 9 a.m. to 5 p.m., excluding holidays. If the User is located abroad, these hours correspond to the time zone applicable in Metropolitan France.

This support is intended to provide the User with solutions to malfunctions and issues encountered while using the Site. This support does not cover the User’s needs related to problems with their hardware or any third-party software not provided by the Publisher.

The Publisher will not provide support services for:

  • Use of the Site by the User in a manner that does not comply with these Terms;
  • Any improper use of the Site, for any reason whatsoever;
  • A compatibility issue between the Site and the User's computer equipment;
  • Any breach by the User of his or her obligations hereunder;
  • In the event of unauthorized modification of the Site by the User or a third party;
  • In the event of a failure of electronic communication networks;
  • In the event of intentional damage, malicious acts, or sabotage;
  • For any damage caused by force majeure or misuse of the Site
